They fixed my car but now it’s not worth as much as it was because its been wrecked! Am I entitled to compensation for my cars diminished value?
Yes. Arkansas law allows a person who has their vehicle damaged due to the carelessness of others to have their vehicle repaired and receive additional money for the loss in the value of their vehicle.
Example. You purchase a car for $20,000.00 and drive it 2 years before someone damages your car in an accident. At the time of the accident your car was worth $12,000.00. The insurance company repair’s your vehicle but afterwards, your car is now only worth $10,000.00. You are still entitled to collect the $2,000.00 in diminished value to your vehicle.
