They fixed my car but now it’s not worth as much as it was because its been wrecked! Am I entitled to compensation for my cars diminished value?

Yes. Arkansas law allows a person who has their vehicle damaged due to the carelessness of others to have their vehicle repaired and receive additional money for the loss in the value of their vehicle.

Example. You purchase a car for $20,000.00 and drive it 2 years before someone damages your car in an accident. At the time of the accident your car was worth $12,000.00. The insurance company repair’s your vehicle but afterwards, your car is now only worth $10,000.00. You are still entitled to collect the $2,000.00 in diminished value to your vehicle. Don’t let the insurance companies hurt you twice!  Put us to work for you to ensure you are full compensated for all of your damages.

I just accepted the insurance company’s offer to settle my personal injury claim, but the check was made payable to me, my own car insurance company and my health insurance company. What should I do?

This question deals with the very technical area called “subrogation.”  If your health insurance company, your car insurance company, Medicaid or Medicare pay medical bills you incur in an accident, they demand to be reimbursed out of your recovery from the other driver.  Beware.  These claims for reimbursement are frequently made when the company or government may not be entitled to be reimbursed.  You do not have to repay your car insurance company if the settlement did not adequately compensate you, your health insurance company may not have the required language in the insurance policy, and the claims of Medicaid and Medicare may be reduced significantly.  A lot of lawyers do not understand this complicated legal area.  We can help.  Call us.
